المسودة الروسية لمشروع الدستور السوري /البرلمان ينحي الرئيس.

نشرت وكالة “سبوتنيك” جزءا من المسودة الروسية لمشروع الدستور السوري الجديد، وهي تضيف لصلاحيات البرلمان إعلان الحرب وتنحية الرئيس وتعيين حاكم المصرف المركزي وتعيين المحكمة الدستورية.
 
وكان الوفد الروسي إلى مفاوضات أستانا حول سوريا، التي جرت يومي الاثنين والثلاثاء الماضيين، قد وزّع مشروعه المقترح للدستور السوري. وسبق لموسكو أن أعلنت، في مايو/أيار الماضي، أنها تعد مثل هذا المشروع، انطلاقا من نتائج مشاوراتها مع أطراف النزاع السوري ودول المنطقة.
 
صلاحيات الرئيس والبرلمان
 
تقترح المسودة توسيع صلاحيات البرلمان السوري بقدر كبير على حساب صلاحيات الرئيس السوري.
 
وجاء ذلك في المادة 44 من مسودة المشروع، إذ ورد فيها “تتولى جمعية الشعب الاختصاصات الآتية: إقرار مسائل الحرب والسلام، تنحية رئيس الجمهورية من المنصب، تعيين أعضاء المحكمة الدستورية العليا، تعيين رئيس البنك الوطني السوري وإقالته من المنصب”.
 
يذكر أن الدستور السوري الحالي لا يمنح البرلمان هذه الصلاحيات.
 
ولم تشر المسودة الروسية إلى حقّ رئيس الجمهورية بحلّ المجلس النيابي، كما لم تشر إلى إمكانيته تعيين نائب رئيس له، وهما من حقوق الرئيس المسجلة في الدستور الحالي.
 
ويمنح الدستور السوري الحالي الحق لرئيس الجمهورية بـ”حل مجلس الشعب بقرار معلل يصدر عنه”، وأن “يسمي نائباً له أو أكثر، وأن يفوضهم ببعض صلاحياته”.
 
وتقترح المسودة الروسية منح رئيس الجمهورية صلاحية إعلان الاستفتاء حول المصالح العليا للبلاد.
 
وجاء في المادة 59 للوثيقة : “يحق لرئيس الجمهورية إعلان الاستفتاء العام حول المواضيع المهمة والتي تخص المصالح العليا للبلد، وتعد نتائج الاستفتاء إلزامية وتدخل حيز التنفيذ اعتبارا من تاريخ إعلانها من قبل رئيس الجمهورية”.
 
وتقترح المسودة الروسية الإبقاء على مدة ولاية رئيس الجمهورية والمحددة بسبع سنوات مع إمكانية الترشح لولاية واحدة تالية.
 
وجاء في البند الأول والثاني من المادة 49: “ينتخب رئيس الجمهورية لمدة سبعة أعوام ميلادية من قبل مواطني سوريا في انتخابات عامة ومتساوية ومباشرة وسرية، ولا يجوز إعادة انتخاب نفس الشخص إلى منصب رئيس الجمهورية إلا لولاية واحدة تالية”.
 
حصص للأقليات وإزالة الإشارة إلى “العروبة”
 
وتقترح المسودة الروسية إزالة تعابير تشير إلى عربية الجمهورية السورية وإحلال اسم “الجمهورية السورية” للتشديد على ضمان التنوع في المجتمع السوري.
 
ويؤكد البند الأول من المادة الأولى: “تكون الجمهورية السورية دولة مستقلة ذات سيادة وديموقراطية تعتمد على أولوية القانون ومساواة الجميع أمام القانون والتضامن الاجتماعي واحترام الحقوق والحريات ومساواة الحقوق والحريات لكافة المواطنين، دون أي فرق وامتياز”.
 
ويقول البند الثالث من هذه المادة نفسها: “بصفة التراث الوطني الذي يعزز الوحدة الوطنية، يتم ضمان التنوع الثقافي للمجتمع السوري”.
 
كما اقترحت المسودة الروسية لمشروع الدستور السوري الجديد جعل تغيير حدود الدولة ممكناً عبر الاستفتاء العام، واعتبار اللغتين العربية والكردية متساويتين في أجهزة الحكم الذاتي الثقافي الكردي ومنظماته.
 
وجاء في البند الثاني من المادة التاسعة لمسودة المشروع: “أراضي سوريا غير قابلة للمساس، ولا يجوز تغيير حدود الدولة إلا عن طريق الاستفتاء العام الذي يتم تنظيمه بين كافة مواطني سوريا وعلى أساس إرادة الشعب السوري”.
 
فيما جاء في البند الثاني من المادة الرابعة “تستخدم أجهزة الحكم الذاتي الثقافي الكردي ومنظماته اللغتين العربية والكردية كلغتين متساويتين.
 
وتشير المسودة الروسية إلى ضرورة مراعاة التمثيل النسبي لجميع الأطياف الطائفية والقومية لسكان سوريا في التعيينات الحكومية، مع تخصيص بعض المناصب لتمثيل الأقليات.
 
وجاء في البند الثالث من المادة 54 للمسودة: “يكون التعيين لمناصب نواب رئيس مجلس الوزراء والوزراء تمسكا بالتمثيل النسبي لجميع الأطياف الطائفية والقومية لسكان سوريا، وتحجز بعض المناصب للأقليات القومية والطائفية، ويحق لرئيس الجمهورية ورئيس مجلس الوزراء التشاور في هذا الخصوص مع ممثلي جمعية الشعب والمناطق”.
 
مكانة القوات المسلحة
 
تشدد المسودة على عدم جواز استخدام القوات المسلحة في المجال السياسي واضطهاد السكان أو عملية انتقال السلطة.
 
وجاء في البند الرابع من المادة العاشرة بالمسودة: “تكون القوات المسلحة وغيرها من الوحدات المسلحة تحت الرقابة من قبل المجتمع وتحمي سوريا ووحدة أراضيها، ولا تستخدم كوسيلة اضطهاد للسكان السوريين ولا تتدخل في مجال المصالح السياسية ولا تلعب دورا في عملية انتقال السلطة”.
 
أولوية القانون الدولي
 
تؤكد المسودة على سمو القانون الدولي والمعاهدات التي تقرها سوريا واعتبارها جزءاً أساسياً من النظام القانوني للدولة.
 
وجاء في البند الثالث من المادة السابعة بالمسودة: “تكون مبادئ وأحكام القانون الدولي المعترف بها ومعاهدات سوريا الدولية جزءا لا يتجزأ من نظامها القانوني”.
 
يذكر أن الدستور الحالي للجمهورية العربية السورية يخلو من أي إشارة إلى المعاهدات الدولية والتزام الدولة بها.
 
وكان وزير الخارجية الروسي، سيرغي لافروف، قد أوضح أن الجانب الروسي  وضع هذا المشروع مع الأخذ بعين الاعتبار ما سمعه طوال السنوات الماضية من الحكومة والمعارضة ودول المنطقة.
 
هذا وأكدت ماريا زاخاروفا، الناطقة باسم وزارة الخارجية الروسية، أن موسكو لا تحاول فرض أفكار ما على أحد، إنما يكمن الهدف من مبادرتها في تحفيز السوريين، لكي يبدؤوا مناقشة هذا الموضوع، فـ “لن يطرح أي من الطرفين أبدا مشروعا يمكن اعتماده كأساس، إنه أمر مستحيل”.

It can be a little scary to think about what the world is coming to. I don’t want the human race to lose track of what really matters- finding and exposing the truth and giving a voice to the voiceless. All the new technological advances that are sure to come hopefully won’t distract and interfere too much with all the ethics and values that journalists attempt to uphold.In order to describe what I think the future is coming to, I’ll use the words of Mr. Newton, “Not just out of the box crazy, off the planet crazy.”

    The Must See Monday presented tonight was unbelievable. Eric Newton, presidential advisor of the Knight Foundation, spoke about the progress man, as a species, has made since 1767. He organized the presentation based on innovations and their respective impacts on the world. Mr. Newton stated that a crisis occurs approximately eighty years, a shockingly accurate statement. He also said that all the advancements in technology, as beneficial as they may be, ultimately would lead to WW3.0. Newton also pointed out how current devices were conceived in past media: Skype from the Jetsons, cell phones in Star Trek, and concepts for future cityscapes. However, from this will arise WW4.0, humans vs. robots: the ultimate showdown and the cliché science fiction theme. Such a possibility is scary to consider, because 2040 is not that far away. Newton reassured us that there are 7 billion reasons none of it will happen. It still did not settle the mood because he ended the presentation with “it’s crazy, so it just might happen.”

    In tonight’s Must See Monday, Eric Newton explained the patterns of the media, and how it is constantly changing. Newton explained how in every generation, there is a change in media, from magazines, to TV news, the internet, and mobile media. But these changes can also be noted all the way back to the American Revolution, when pamphlets advanced to newspapers, and so on. But the greatest question in the future of media is…where do we go from here? Newton showed the audience some great examples of “skyping” on The Jetsons and using cell phones on Star Trek. All that can be laughed at by American’s today. But Newton said that even the creator of the cell phone based his idea off of the show. So while we laugh at sci-fi movies and think of their technology as unimaginable, they are really not far off. Technology of the future may even soon be based off of ‘The Terminator’ or ‘Avatar.’ After all, Newton said the first principle in creating the future is to “think crazy.” I think the most interesting part of Newton’s presentation was the categories he made for future generations, listing all the way up to 2110. Will ideas and skills soon be programmed into our brains? Is there a possibility of a World War 4.0 Man vs. machine, or Man vs. nature? These ideas may seem a little far-off, but remember, one hundred years ago the idea of a cell phone seemed a little crazy too. Taking away from Newton’s presentation, it is easy to see where we all lie in the middle of this. As journalism students, we are the future, and it is our job to decide where the future of the media goes. The best minds did their greatest works in their 20’s, and as young adults, we hold the power in our hands for generations to come.

    The Cronkite School ended the semester with a Must See Monday that explored the great strides students are making as digital media entrepreneurs. Dan Gillmor and CJ Cornell introduced four students who accepted a challenge and dove head first into the ambiguous world of entrepreneurship. Each had their own project that proved innovation in new media is the next step in journalism. From community service to a modern day town crier the students have taken a look at what people need and how to address that need with what the community already has. The display of student projects was a glowing affirmation that we have the ability to create our own place in the world. With the intentions to inform the public around us we have the chance to secure ourselves financially as well. New media seems to be a constant in every facet of life today. With the release of the iPad, continuous updates to our favorite search engines, or the LCD screens that play while we pump our gas, the outlet for journalism is growing and these students are taking full advantage of it. This Must See Monday confirms that the Cronkite School is on the cusp of innovation; adapting to the rapid changes that effect the world of journalism every day, like the opportunities for students through the Knight Center for Digital Media Entrepreneurship, ensures that the school is molding Journalists that will thrive.

Eric Newton, Senior Advisor to the president of the John S. and James L.     This evening in the First Amendment Forum, Eric Newton brought a very intriguing topic to the table. With the uncertainty of the future of journalism and its rapid progression in the digital age, it is hard to not wonder what the future holds. In front of one of the largest crowds of this year’s Must See Monday series, Mr. Newton explained his theory on how technology and journalism will progress into the year 2110. With history showing the exponential growth of forms of communication, it is only logical to think technology will keep progressing and bring new mediums of journalism to our society. Newton stated, “Today, we are just scratching the surface of the digital age.” He believes that science fiction is a great predictor of what the future holds. Today’s technologies, such as Skype and cell phones, were depicted on television many years before they were actually invented. Newton predicts that there will be a World War 3.0 (cyber war) and also World War 4.0 (man vs. machine). He also discussed his prediction that between 2090-2110 we will have “omni media” which includes thought projection and telepathy. These are all very wild guesses, but he stated that you must think in a crazy way in order to make great advances.

    A story of conspiracy, The Pelican Brief, starring award-winning actors Julia Roberts and Denzel Washington, depicts a thrilling and suspenseful investigation. I’ve always been fascinated with Washington D.C, and this film drives my intrigue even further because of its exposure of corruption within the capital. Also, it successfully demonstrates how far some people will go to cover up their lies and greed. As a journalist, this movie inspires me to dig deep for the truth, despite the possible frightening outcomes on the other end, like the blowing up of a car and most dramatically murder, as shown in the movie. Even though the film doesn’t exhibit all journalistic principles, such as when Darby (Roberts) lies about who she is in order to find Gray (Washington), the characters portray an honest search for answers. The movie beings with shocking deaths and then everyone who learns about the brief appears to be dying , but Gray’s curiosity and Darby’s persistence lead them to expose what a corrupt and murderous man Mattiece was. For a Cronkite Night at the movies this deserves five stars.

News and communication started out as something visual and then transformed into something oral that was spread through word of mouth. Eric Newton explained specific patterns of how history repeats itself over the years. He also explained how many of the inventions we find in our daily lives such as cell phones or satellites came from science fiction writers and their vivid imaginations. Newton sees the future of communication and news as a third and fourth world war against technology much like a science fiction writer would. Although in the time frame he gave us it is a possibility that that could occur I don’t necessarily believe it will. Newton explained that in order to get to the future, there needs to be people to shape it. As a journalist, I’m not so sure that I want to take part in the shaping of our destruction.

Respect for the victims was the theme of the night, as all cases they talked about demanded respect for the victims, the event, and the other people involved. Being able to connect to the people involved opened the door for Merina in the aftermath of Hurricane Katrina, because it allows for people to see that your not out to harm them. As a Cronkite student, I feel that we are blessed with the proper tools and training to allow us to cover these events right. We are required to take ethics, but also we learn how to report ‘old-fashioned,’ and more to get the best story not just the quick story. That training allows for us to be human beings as well as reporters.

It is so fulfilling and reassuring to hear such esteemed professionals in the world of journalism compliment our school and its abilities to produce successful young journalists. Newton even mentioned that we have a Dean with ‘superhuman powers.’ With these powerful words, I felt more motivated to pursue a future in journalism than I ever have before. Often times, critics say that journalism is fading, but after tonight’s Must See Monday event, it seems there is no refuting its future potential. Eric Newton presented an interesting look into the past and predicted future of journalism through mass media outlets and other various forms of communication. I cannot wait to become a part of a generation of innovative individuals who work to make science fiction’s crazy predictions prove to be possible. The Digital War is looming, as our cyber armies are currently being built. And,” We are here, right in the middle of it all,” as machines will become self-aware. Back tracking to his opening, words, Newton stated points of our “History of the Future of News: What 1767 tells us about 2100.” One point was that every American generation grows up with a different form of media. Though I never experienced Hawking and his wild predictions personally, I knew that Newton related as another innovating mind just in the journalism world. Knight Foundation, told us that the future of journalism is unknown. He spoke of the beginning and life of journalism throughout all of time, even mentioning the estimate of the very first news story, 1-2 M B.C. He also told us how mass media changed the world, with the beginning of printing books and newspapers. Journalism has gradually changed over the generations, and this is because every eighty years there is a great awakening. This means there are new thoughts and ideas being used to better journalism and media that eventually changes how it was previously done. When he spoke of the future of journalism, he helped us imagine a news story from across the world, in which the story was presented as if you were actually there watching it play out through Nano technology.     This week’s Cronkite’s night at the movies was thrilling to say the least. “The Pelican Brief” was thrilling and exhilarating. The movie is surrounded by a conspiracy underlying the murder of two very different Supreme Court justices sends people into a frenzy, causing numerous murders and leads to a complicated journey to the truth. The murders that take place at the beginning of the movie are very intriguing and really reel the audience in. One thing this movie does really well is the use of the “shock factor.” A lot of the murders to me were so unexpected and bizarre. The story really leaves the audience asking themselves what just happened and what is going to happen next. Each time I thought it couldn’t get any crazier it does, which makes for a great story and movie. Another thing the movie really displays well is paranoia. The characters show it well and there were even times where I got paranoid just watching it. The fact that the reporter gets paranoid in his cabin shows his belief in Darby’s story and understanding of the seriousness of what they are dealing with. There were many times in the movie when I found myself thinking this can’t get any worse, then some light shines on the subject only to get even darker than it was before. The action was very effective as there were times when my heart started racing in anticipation especially during the parking garage scene toward the end of the movie. A part from being really entertaining I found the investigative reporting very well thought out. Although they do some sneaking that could be thought of as bad, I think that there intentions were very pure. Once again, this movie made me appreciate journalism. The reporter, Grantham, knew how serious obtaining information on the brief was but he investigated it anyway. It really boosted my assurance that journalism is the profession for me. Although not all stories are going to be as exciting or life threatening as the one in the movie, my goal is to help people which is ultimately what Grantham does by taking on this story. I am really glad that I attended this week’s movie as it was super entertaining. I could find myself watching this movie again.
